Duplication - Moving Images
The Briscoe Center offers moving image reproductions of research materials to all on- and off-site researchers, as long as:
- These reproductions do not violate Title 17 of the U.S. copyright law that governs the making of reproductions of copyrighted materials.
- Donor agreements do not restrict reproduction.
- These reproductions can be produced without damage or risk of damage to the original materials.
All duplications are done in DVD (MPEG-2) format unless otherwise requested and at the Briscoe Center’s discretion.
Researchers interested in requesting a reproduction of moving image materials should complete a Photograph/Moving Image Order Form (pdf) and a Permission to Publish or Use Reproductions of Materials (pdf) form if applicable. Copyright Concerns
Copyright permission is not required for moving image duplication for personal or research use in cases where the Briscoe Center controls copyright. Where the Briscoe Center is not the copyright holder, proof in writing of permission from the copyright holder must be presented for reproductions, regardless of use.
Clearance of copyright is always the responsibility of the person wishing to publish or display material. Patrons are responsible for securing permission to reproduce materials either from the BCAH or from other copyright holders and for complying with copyright laws.
In all cases, written permission to publish or display reproductions of the BCAH materials must be secured from the Briscoe Center as owner of the physical property prior to the use of the materials. Patrons must fill out a Permission to Publish or Use Reproductions of Materials (pdf).
A complimentary copy of the final publication in any medium using reproductions of Briscoe Center for American History materials must be donated to the Briscoe Center.
Commercial use of these images is prohibited without prior permission from and payment of fees to the Briscoe Center for American History.
Pricing
Moving image duplication decisions are made on a case-by-case basis by the Briscoe Center’s staff. Some materials cannot be duplicated due to condition or other restrictions. Patrons must completely fill out a Photograph/Moving Image Order Form (pdf) and a Permission to Publish or Use Reproductions of Materials Form (pdf) to conform to current United States copyright laws. Please consult with the BCAH Reference Staff for any assistance needed. Payment in advance is required for all moving image orders. Do not send payment until the Photo Services Coordinator has contacted you. You will be contacted by email unless otherwise requested. Texas Sales Tax of 8.25% is applicable to all Texas transactions. Patrons with Tax Exempt Status must complete the Texas Sales and Use Tax Exemption form 01-339.
Fees for Reproductions
A fee of $30 per duplication is charged. Some items that cannot be duplicated in house will be charged at current market prices. A media fee of $3.00 will be charged for each DVD-R disk supplied.
In addition to the above fees, the following preservation fees apply:

| UT System faculty, staff, students, and departments | $10.00 per copy |
Delivery
Delivery times vary but average between two and three weeks after payment. Larger orders may take longer. Rush delivery of five business days from the date of payment is available for some items at the discretion of Center staff. There is a $20 surcharge per item for rush delivery fees.
A handling fee of $6.00 per order is charged for orders that must be mailed out. No handling fee is charged for orders picked up at the Briscoe Center. Patrons whose orders are to be mailed outside the United States must also provide an express mail account or credit card number for express mail service.
