Permission & Copyright

The Center for American History at The University of Texas at Austin Research and Collections Division is a special collections library and archive that facilitates research on the historical development of Texas, the American South, American politics, and the American news media. The R&C Division supports research and education by acquiring, preserving, and providing access to rare and unique research materials in a closed stack, noncirculating environment. We offer photographic reproductions of research materials to researchers in the James Stephen Hogg Reading Room, as well as researchers who cannot visit in person,

as long as:
    1. These reproductions do not violate Title 17 of the U.S. copyright law that governs the making of reproductions of copyrighted materials.

    2. Donor agreements do not restrict photographic reproduction.

    3. These reproductions can be produced without damage or risk of damage to the original materials. Concerns may include but are not limited to:

    • Fragile or unstable photographic materials
    • Non-photographic visual materials on brittle or fragile paper
    • all materials larger than 40" x 50"

Copyright Concerns

Copyright permission is not required for photographic duplication for personal or research use in cases where the Center controls copyright. Where the Center is not the copyright holder, proof in writing of permission from the copyright holder must be presented for photographic reproductions, regardless of use.

Clearance of copyright is always the responsibility of the person wishing to publish or display material. Patrons are responsible for securing permission to reproduce materials either from the CAH or from other copyright holders and for complying with copyright laws.

In all cases, written permission to publish or display reproductions of the CAH materials must be secured from the Center as owner of the physical property prior to the use of the materials. Patrons must fill out a Request for Permission to Publish or Use Reproduction of Materials. A complimentary copy of the final publication in any medium using reproductions of Center for American History materials must be donated to the Center.

Scanners are not permitted in the reading room.

Cameras, digital cameras, and video equipment may only be used with special permission from the CAH Staff and by appointment.

Use of images on the Center for American History Web site

Unless marked or otherwise protected, the digital images on the Center’s Web site may be reproduced for non-profit classroom use without charge, provided appropriate credit is given. We do require that users submit our Permission to Publish Form via mail or fax to the Photography Services Coordinator.

When crediting images from this site for non-profit classroom use, please use: "Courtesy Center for American History, The University of Texas at Austin."

Commercial use of these images is prohibited without prior permission from and payment of fees to The Center for American History. In most cases, we also require that patrons order a high-resolution scan, a color transparency, or a print. Please see our Photoduplication Price List and Photograph Order Form.

This site provides access to images for which the copyright is held by owners other than the Center for American History. Any use of these images is restricted by copyright law. Please contact the Photography Services Coordinator for further information.
